Terms of Service

1. Acceptance of Terms

By accessing or using CutArc ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

CutArc is a suite of browser-based design and manufacturing tools including:

• CutArc Plasma — CAD/CAM software for CNC plasma cutting with G-code generation
• CutArc Laser — CO2 laser cutter control and job management
• CutArc Vinyl — Vinyl cutter design and machine control
• CutArc AI Generate — AI-powered vector design generation and photo-to-SVG conversion

The Service allows users to create designs, import and export files, configure machine parameters, and control compatible CNC equipment.

3. User Accounts

To access certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4. Pricing and Subscriptions

CutArc offers a free tier and paid subscription plans:

• Free: Core design tools, unlimited G-code generation, and limited AI generations. For personal, non-commercial use.
• Pro Commercial ($14.99/month): Unlimited exports, increased AI generations, full design library access, and a commercial use license.
• Shop ($49/month — coming soon): Everything in Pro plus work orders, remnant tracking, batch tools, and priority support.

AI credits may also be purchased separately for use across all products. Credits do not expire.

Payments are processed by Stripe. Subscriptions auto-renew unless cancelled. You may cancel at any time through the billing portal; access continues until the end of the current billing period. We reserve the right to change pricing with 30 days advance notice to active subscribers.

5. Commercial Use License

The Free tier is for personal, non-commercial use only. To sell products made with CutArc (signs, parts, artwork, etc.) or use the Service in a business context, you must hold an active Pro Commercial or Shop subscription. Designs you create are yours — the commercial license governs use of the Service itself, not ownership of your work.

6. AI-Generated Content

Designs created using AI Generate or Photo to SVG are produced by third-party AI models. You may use AI-generated designs in your projects subject to your subscription tier's commercial use terms. CutArc does not claim ownership of AI-generated designs. We do not guarantee that AI-generated designs are unique or free from similarity to existing works.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to reverse engineer or extract source code
• Share account credentials with unauthorized users
• Interfere with or disrupt the Service
• Use automated systems to access the Service without permission
• Circumvent subscription tier restrictions or usage limits

8. Intellectual Property

The Service, including its design, code, and branding, is owned by CutArc. You retain ownership of designs you create. By using the Service, you grant us a limited license to process your designs for the purpose of providing the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that:

• The Service will be uninterrupted or error-free
• Generated G-code or machine commands will be suitable for your specific equipment
• AI-generated designs will meet your expectations or be error-free
• Results will meet your expectations

IMPORTANT: You are solely responsible for verifying G-code and machine command compatibility with your equipment and ensuring safe operation. Always review generated output before running on your CNC machine, laser cutter, or vinyl cutter.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUTARC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Equipment damage from using generated G-code or machine commands
• Personal injury resulting from machine operation
• Lost profits or business interruption
• Data loss or corruption

11. Refund Policy

Subscription fees are non-refundable except where required by law. AI credit purchases are non-refundable once credits have been used. If you experience a billing error, contact us within 30 days.

12. Indemnification

You agree to indemnify and hold harmless CutArc from any claims arising from your use of the Service or violation of these terms.

13. Changes to Terms

We may update these terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated via email or Service notification.

14. Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time through the profile settings. Upon termination, active subscriptions will not be renewed and unused AI credits will be forfeited.

15. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the appropriate courts.
